Refund policy
Returns and withdrawal
1. Statutory right of withdrawal
Consumers have a statutory right of withdrawal for distance contracts for goods with Sugle Germany GmbH, trading under the Switory brand, where such a right applies. This right exists independently of the additional voluntary 30-day return right. The voluntary return conditions do not restrict the statutory right of withdrawal. Business customers do not have a statutory consumer right of withdrawal; previously agreed return rights and statutory rights in respect of defective goods remain unaffected.
2. Withdrawal instructions
You may withdraw from your contract without giving any reason within fourteen days. Depending on the agreed delivery, the period starts as follows:
- For a delivery of goods, the period starts when you or a third party designated by you, other than the carrier, receives the goods.
- For a single order involving separate deliveries of goods, receipt of the last item is decisive.
- For goods delivered in several lots or pieces, receipt of the last lot or piece is decisive.
- For a consumer sales contract for the regular delivery of goods over a defined period, the period starts when you or a third party designated by you, other than the carrier, receives the first goods (section 356(2), point 1(d) of the German Civil Code).
The period does not start before the legally required information about the right of withdrawal has been provided. Where there are several legally independent purchase contracts, the starting point must be determined for each contract.
Inform the following contact of your withdrawal by a clear statement, for example by letter or email:
Sugle Germany GmbH
Rahmannstraße 11
65760 Eschborn
Germany
Email: info@sugle-germany.de
Telephone: +49 6196 5255487
You may use the form below, but you are not required to do so. It is sufficient to send your withdrawal statement before the period expires. Our prior approval is not required.
3. Model withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)

4. Voluntary 30-day return right
We additionally grant the previously promised 30-day return right. For an order, the voluntary 30-day return period starts on receipt of the last item. If the period ends on a Saturday, Sunday or public holiday, it is extended until the next working day. Within this period, you may request a return at info@sugle-germany.de. For this voluntary return, the item must be in the same condition as when received: unworn, unused, with any labels and in its original packaging. A receipt or other proof of purchase is required. For a voluntary return, please contact our customer service team at info@sugle-germany.de before sending the goods back. Our customer service team will provide the return address and the necessary return instructions.
The previous exclusion of sale items and vouchers applies only to voluntary returns, insofar as that exclusion was validly agreed. It does not restrict any statutory right of withdrawal or statutory rights in respect of defective goods. Return rights that have already arisen or more favourable contractual return rights remain in place; this statement does not reduce them retrospectively.
Return labels and return instructions already promised remain part of the relevant promise. This does not create any additional promise of free returns or a new automated return procedure.
5. Returning goods and return costs
Following statutory withdrawal, you must send the goods back without undue delay and no later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you send the goods before the fourteen-day period expires. Prior approval is not required to exercise the statutory right of withdrawal.
Return address:
Sugle Germany GmbH
Saalestr. 20
39126 Magdeburg
Germany
The goods can be returned as ordinary parcels. For statutory withdrawal, you bear the direct costs of returning the goods if we properly informed you of this before the contract was concluded and no agreement to cover those costs exists. For a voluntary return without a quality defect, you bear the direct return costs unless more favourable conditions have already been promised to you. Statutory claims concerning defective or incorrectly delivered goods remain unaffected.
6. Refunds
For statutory withdrawal, we refund all payments received from you, including the cost of the least expensive standard delivery offered by us, without undue delay and no later than fourteen days after receipt of your withdrawal statement. Additional costs resulting from your choice of a more expensive delivery method are not refunded. We use the same means of payment as for the original transaction unless expressly agreed otherwise; you incur no charges for the repayment.
If we have not offered to collect the goods, we may withhold repayment until we have received the goods back or you have provided evidence that you have sent them back, whichever is earlier. The statutory refund does not depend on separate return authorisation.
For a voluntary return, we inform you of acceptance after receiving and inspecting the goods. The previous promise of a refund within ten working days after approval remains in place. Existing more favourable rights are not restricted. The payment provider's processing and crediting times may vary; this does not extend any statutory refund deadline.
7. Rights in respect of defective goods and statutory exceptions
Your statutory rights concerning defective or incorrectly delivered goods remain unaffected. Unused goods, attached labels and original packaging are not prerequisites for statutory withdrawal. You are liable for any diminished value only where the statutory conditions are met, in particular where it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods and the legally required information has been provided.
Statutory exceptions to the right of withdrawal apply only where their conditions are actually met in the individual case. These may include, in particular, goods that are not prefabricated and are made according to the customer's individual selection or clearly personalised. A reduced price alone does not exclude the statutory right of withdrawal. Blanket exclusions for all sale items or all special orders are not applied to the statutory right of withdrawal.
8. Subscriptions and recurring deliveries
Withdrawal and cancellation of future subscription deliveries are different declarations. For a contract for regular deliveries of goods over a defined period, the statutory withdrawal period starts on receipt of the first goods. For legally independent purchase contracts, the starting point must be determined separately for each contract. Whether a subsequent delivery fulfils a new contract depends on the contractual structure actually agreed. Previously agreed voluntary return rights remain unaffected.
Additional requests through the customer account
Where the relevant function is enabled in your customer account, you may additionally request a return or cancellation of items that have not yet been dispatched. Access is through your customer account. Login is required for this additional account function. Such a request does not automatically end a subscription. You may exercise your statutory right of withdrawal independently by a clear statement, particularly by email or letter; prior approval is not required.
